General terms and conditions of delivery and sale
1. General
The following conditions apply to every delivery to be carried out by Digipack AG. Further verbal agreements or deviations from the conditions only become legally effective with written confirmation from Digipack AG.
2. Prices
All prices are net ex works, excluding packaging and VAT. Cash discounts are granted by agreement. The same prices apply for shipments abroad, excluding Swiss VAT.
3. Customs for shipments abroad
When shipping abroad, customs fees for customs clearance and VAT are incurred; these are not included in the price and will be invoiced separately upon delivery.
4. Price changes
Digipack AG can change or adjust the price list at any time. The agreed prices apply to contracts that have already come into force and are ongoing. The price of the order is binding, except for obvious errors (e.g. 20.- instead of 200.-).
5. Payment
The invoiced amounts are payable net within 30 days of the invoice date. For private customers, deliveries are only made against advance payment, cash on delivery (surcharge of CHF 15) or cash on collection. Special agreements are reserved. The payment deadline must also be met if transport, delivery or acceptance of the delivery is delayed (for reasons for which we are not responsible). We reserve the right to terminate the contract and demand compensation for the costs incurred if the customer does not comply with the contractually agreed arrangements.
6. Shipping costs
We will invoice the actual postage and shipping costs to the post office. The goods travel at the customer's risk in all cases. If you specifically request it, we can deliver your order by express or courier. Shipping usually takes place within 3-4 days of receiving your order.
7. Right of return (only applies if ordered via shop)
You have an unlimited right to return the entire delivery within 5 days of the delivery date. This applies to the entire delivery and all goods received. The goods must be returned to us in an unused, unchanged condition and in undamaged packaging. In the case of hidden defects, these must be reported in writing, otherwise no credit or replacement delivery can be made. We reserve the right to request the return of the goods for inspection in the event of hidden defects.
9. Retention of title
Digipack AG remains the owner of its entire delivery until all payments have been received in accordance with the contract.
10. Legal notice
The place of performance and jurisdiction for all liabilities arising from the legal relationship between the customer and Digipack AG is the company's registered office. Swiss law applies.
